2. MyBite Is Strictly 18+
MyBite is available only to individuals 18 years of age or older.
We may request date-of-birth or equivalent age-eligibility information before account creation or access to nutrition and AI functionality.
If information indicates that you are under 18, you may not create a MyBite account, use AI-powered food analysis, use account-based nutrition features, or purchase a subscription through the Service.
Where technically appropriate, we minimize full date-of-birth information after eligibility is determined and retain only information reasonably necessary for eligibility, security, fraud prevention, audit, or legal compliance.
3. Information We Collect
Depending on the features you use, we may process:
Account and Contact Information
Email address, account identifier, authentication information, language, country/storefront information, preferences, and support/privacy communications.
Age and Eligibility Information
Date of birth, age, age range, age-verification result, or 18+ eligibility status.
Nutrition, Wellness, and Body Information
Height, weight, target weight, activity level, calorie or macronutrient goals, dietary preferences or restrictions, allergies voluntarily provided by you, foods and beverages consumed, meal history, nutrition information, progress information, and related nutrition/wellness inferences.
Some of this information may qualify as health data, sensitive personal information, consumer health data, or special-category personal data under applicable law.
Food Images and Camera Data
Food or meal photographs, product packaging, barcodes, nutrition labels, and information derived from those images.
Do not intentionally submit unrelated people, identification documents, financial information, medical records, or other unnecessary sensitive information.
Device, Security, Usage, and Diagnostic Information
Depending on the shipping configuration, this may include device model, operating system, app version, IP address where processed by infrastructure, approximate country/region, timestamps, security events, network information, app interactions, performance information, errors, or crash information.
Subscription and Purchase Information
Apple and RevenueCat may provide limited information such as subscription product, purchase status, renewal status, transaction or receipt-related information, entitlement status, storefront, and an App User ID or similar identifier.
Apple processes payment-card information for App Store purchases. MyBite generally does not receive full payment-card details.
4. Sources
We may obtain information:
- directly from you;
- from food images, labels, barcodes, text, and other content you submit;
- automatically through your use of the Service;
- from authentication and cloud providers;
- from Apple and RevenueCat for purchase/subscription administration;
- from AI, nutrition, food, barcode, or product-data providers; and
- from security or support providers.
5. How We Use Information
We may use information to:
- determine age eligibility;
- create, authenticate, secure, and manage accounts;
- provide food recognition and nutrition estimates;
- provide barcode or nutrition-label functionality;
- maintain meal history, goals, and progress;
- personalize functionality you request;
- maintain subscription entitlements;
- provide support and respond to privacy requests;
- prevent fraud, abuse, and security incidents;
- diagnose technical problems and improve reliability;
- enforce our Terms;
- comply with legal obligations; and
- establish, exercise, or defend legal claims.
MyBite does not provide medical diagnosis or treatment.
6. Health and Sensitive Information
Food intake, meal history, weight, body information, allergies, dietary restrictions, nutrition goals, and related inferences may be treated as sensitive or health-related information under applicable law.
MyBite does not intentionally:
- sell identifiable health or nutrition information;
- rent identifiable health or nutrition information;
- provide identifiable health information to data brokers;
- use health or nutrition information for third-party targeted advertising; or
- send meal, weight, calorie, allergy, dietary-restriction, or food-photo information to advertising platforms to build advertising profiles.
Where applicable law requires express or explicit consent for sensitive or health-related information, MyBite obtains that consent separately from general Terms acceptance.
7. Health and Nutrition Consent
Where required by law or used as MyBite’s legal basis, MyBite presents a separate affirmative consent before processing health- or nutrition-related information for the relevant functionality.
We may retain evidence of that choice, including user ID, consent version, status, timestamp, app version, and relevant country/storefront information.
You may withdraw consent prospectively through available privacy controls or by contacting us.
If a feature cannot function without the relevant health or nutrition processing, withdrawal may make that feature unavailable.
8. European Union Legal Bases
Where the GDPR applies:
- ordinary personal information necessary to create and provide the Service may be processed to perform a contract or take steps requested by you;
- where nutrition, weight, or related information constitutes data concerning health or another special category, MyBite relies on an appropriate Article 9 condition, including explicit consent where applicable;
- ordinary personal information may be processed for legitimate interests such as security, fraud prevention, reliability, debugging, and protection of legal rights where permitted and appropriately balanced; and
- information may be processed to comply with legal obligations or establish, exercise, or defend legal claims.
9. AI Processing
MyBite may use Google LLC through paid Gemini API services for requested AI-powered food analysis.
An AI request may include a food photograph, meal description, nutrition-label image, and limited context necessary to return a result.
MyBite does not intentionally include direct account identifiers such as your name, email address, or full date of birth in an ordinary food-analysis request when those identifiers are unnecessary for the analysis.
Google’s then-current paid-service terms, data-processing terms, security practices, and applicable retention/logging rules govern its processing.
MyBite does not claim that Gemini processing has zero data retention unless MyBite has specifically verified and implemented a configuration that supports that claim.
10. Material Service Providers
Current material providers include:
- Google LLC / Google Cloud / Firebase — authentication, cloud infrastructure, databases, storage where enabled, server processing, and security;
- Google LLC / paid Gemini API — AI analysis of food images, labels, text, and related inputs;
- RevenueCat, Inc. — subscription entitlement and purchase-status management; and
- Apple Inc. — App Store distribution, billing, subscriptions, and refund administration.
Other food, nutrition, barcode, or product-data providers may be used where necessary for requested functionality and must be evaluated under MyBite’s privacy and vendor controls before processing user-linked personal information.
MyBite does not intentionally send food photographs, meal history, weight, calorie history, dietary restrictions, allergies, health-consent status, or similar health information to RevenueCat as customer attributes.
11. Disclosure of Information
We may disclose information:
- to processors and service providers operating the Service on our behalf;
- to Apple and RevenueCat for purchase and entitlement administration;
- to professional advisers such as lawyers, accountants, auditors, security professionals, or insurers where appropriate;
- to authorities or legal recipients where disclosure is required or legally justified;
- to prevent fraud, abuse, or threats to rights or safety; and
- in connection with a merger, financing, acquisition, reorganization, bankruptcy, or sale of all or part of our business, subject to applicable law.
Processors are not authorized by MyBite to use MyBite health information for their own unrelated advertising purposes.
12. No Sale of Consumer Health Data
MyBite does not sell consumer health data.
If this practice changes in a manner that legally constitutes a sale, MyBite will provide the notice and obtain any separate authorization required by law before the new activity begins.
13. Advertising and Tracking
MyBite may advertise its own Service through third-party platforms and may use limited campaign or attribution information where permitted.
MyBite does not intentionally disclose health or nutrition information to third-party advertising platforms for targeted advertising.
At launch, MyBite does not use health or nutrition information for cross-app tracking or IDFA-based targeted advertising.
If MyBite later introduces tracking that requires Apple App Tracking Transparency or additional legal consent, the required disclosures and consent controls will be implemented first.
14. Food-Image Retention
MyBite minimizes retention of raw food images.
Images submitted only for an AI scan are retained only as long as reasonably necessary to provide the requested analysis, secure or troubleshoot the Service, satisfy limited operational requirements, and comply with law, unless you deliberately save an image to your meal history.
Temporary copies may exist for limited periods in processing systems, caches, security systems, backups, or processors according to applicable contracts and system configuration.
Saved meal photographs may remain associated with your account until deleted, account deletion, or expiration of the applicable retention period.
15. AI Model Training and Product Improvement
We may use aggregated or de-identified information to evaluate and improve MyBite where permitted by law.
Acceptance of this Privacy Policy is not blanket consent for MyBite to use identifiable health information or identifiable raw food photographs to train proprietary AI models.
If MyBite later wishes to use protected information for research, dataset creation, model training, or another materially different purpose, MyBite will provide any additional notice and obtain any permission required by applicable law before that use.
16. Retention
We retain personal information only as long as reasonably necessary for the disclosed purposes and for lawful security, accounting, tax, fraud-prevention, dispute, compliance, and legal-claim needs.
Retention depends on factors such as:
- whether your account remains active;
- whether you choose to maintain meal/progress history;
- whether information is needed for a transaction or subscription;
- whether records are needed for security, fraud, legal, accounting, or tax purposes;
- whether consent or privacy-request evidence must be preserved; and
- applicable limitation periods or legal requirements.
Where feasible, information is deleted, de-identified, or overwritten when it is no longer needed.
17. Security
We use reasonable administrative, technical, and organizational safeguards appropriate to the nature and risk of the information processed.
Measures may include encryption in transit, encryption at rest where appropriate, authentication, access controls, least privilege, secrets management, environment separation, monitoring, logging controls, rate limiting, vendor review, and incident-response procedures.
No system can be guaranteed completely secure.
18. International Transfers
JD INTERNATIONAL LLC is a U.S. company, and service providers may process information in the United States and other countries.
Where applicable law restricts international transfers, MyBite uses a legally permitted mechanism, contractual safeguard, assessment, or other lawful basis.
For EU personal information, safeguards may include European Commission Standard Contractual Clauses and supplementary measures where required.
For personal information subject to Quebec law, MyBite conducts required privacy impact assessments before applicable communications outside Quebec and uses required written arrangements.
For Serbia, MyBite implements the transfer mechanism required by Serbian law as confirmed by Serbian counsel.
19. Your Privacy Rights
Depending on where you live, you may have rights to:
- confirm or know whether we process your information;
- access information;
- obtain a copy;
- correct inaccurate information;
- request deletion;
- request restriction;
- object to certain processing;
- obtain portability;
- withdraw consent;
- opt out of certain sale, sharing, or targeted advertising activities where applicable;
- appeal certain denied privacy requests; and
- complain to an appropriate regulator.
To exercise a right, email jankoviraldev@gmail.com with subject “Privacy Request.”
We may verify identity or authority before fulfilling a request.
20. Account Deletion
You may initiate account deletion through MyBite’s in-app account settings or contact jankoviraldev@gmail.com.
Deleting a MyBite account and cancelling an App Store subscription are separate actions.
We delete or de-identify account-associated information as required by law, subject to legally permitted retention for transactions, tax/accounting, security, fraud prevention, disputes, legal claims, backups, and other lawful purposes.
21. European Union — Slovenia, Italy, and Croatia
MyBite intends to offer the Service to adults in Slovenia, Italy, and Croatia.
Where the GDPR applies, users may have rights including access, rectification, erasure, restriction, portability, objection, withdrawal of consent, and the right to lodge a complaint with a competent supervisory authority.
Where Article 27 GDPR requires MyBite to appoint an EU representative, the representative information in Section 1 will be completed.
EU users may complain to the supervisory authority in the Member State of their habitual residence, place of work, or place of the alleged infringement.
22. Serbia
Serbian data-protection law may apply to MyBite as a foreign controller offering services to individuals in Serbia.
Where applicable, Serbian users may have rights concerning access, correction, deletion, restriction, portability, objection, consent withdrawal, and complaints.
Where health-related information qualifies as a special category of personal data, MyBite uses an appropriate legal condition and obtains explicit consent where required.
Where Article 44 requires a Serbian representative, the representative information in Section 1 will be completed.
Serbian users may have the right to complain to the Commissioner for Information of Public Importance and Personal Data Protection.
23. Canada and Quebec
MyBite’s Privacy Officer is identified in Section 1.
Where Canadian privacy law applies, MyBite follows applicable requirements concerning accountability, identified purposes, meaningful consent, limiting collection/use/disclosure/retention, safeguards, openness, access, correction, and complaint handling.
MyBite uses express consent where required for sensitive information.
Where Quebec law applies, MyBite maintains required privacy governance, conducts applicable privacy impact assessments, uses required safeguards for communications of information outside Quebec, and records/responds to confidentiality incidents as required by law.
Canadian users may have the right to complain to the Office of the Privacy Commissioner of Canada or an applicable provincial privacy authority.
24. United States
U.S. residents may have additional rights under applicable state privacy laws.

If another state law applies to MyBite, MyBite will honor the rights and obligations required by that law.
25. Security Incidents
If a security incident involving personal information occurs, MyBite will investigate and make notifications to affected individuals or regulators where required by applicable law.
