MyBite Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy (“Health Data Policy”) supplements the MyBite Global Privacy Policy and describes how JD INTERNATIONAL LLC d/b/a MyBite (“MyBite,” “we,” “us,” or “our”) handles information that may qualify as “consumer health data” or similar protected health-related information under applicable U.S. state law, including the Washington My Health My Data Act, Nevada consumer-health-data law, Connecticut privacy law, and other applicable state requirements.
If this Health Data Policy conflicts with our Global Privacy Policy concerning consumer health data, this Health Data Policy controls to the extent required by law.
1. Consumer Health Data
Depending on applicable law, consumer health data may include personal information linked or reasonably linkable to a consumer that identifies or permits an inference concerning physical or mental health, health status, or health-related characteristics.
For MyBite, this may include nutrition information, food intake, weight or body information, dietary restrictions, nutrition goals, food images used to derive nutrition information, and related inferences.
2. Categories We May Collect or Derive
Nutrition and Food Information
Foods and beverages consumed; meal history; calorie, protein, carbohydrate, fat, and nutrient information; dietary preferences or restrictions; allergies voluntarily provided by you; barcode/product/ingredient information; and estimated nutritional composition.
Body and Wellness Information
Height; weight; target weight; weight history; body measurements voluntarily provided; activity level; nutrition/wellness goals; calorie or macronutrient goals; and progress information.
Food Images
Food or meal photographs; product packaging; nutrition labels; barcode images; and nutrition-related information derived from images.
Inferences
Estimated calorie consumption; estimated macronutrient intake; estimated portion size; estimated nutritional composition; and progress toward user-selected goals.
MyBite does not intentionally request unrelated medical records, diagnoses, prescriptions, reproductive-health information, or other medical information unnecessary for its core nutrition functionality.
3. Sources
We may obtain consumer health data from:
- you directly;
- food photographs and labels you submit;
- barcodes you scan;
- information you enter manually;
- calculations or inferences generated from your inputs;
- food, nutrition, product, ingredient, or barcode data sources; and
- processors operating on our behalf.
4. Purposes
We may collect and use consumer health data to provide:
- food logging;
- food recognition;
- calorie and macronutrient tracking;
- product or ingredient identification;
- portion estimation;
- barcode scanning;
- nutrition-label analysis;
- meal history;
- nutrition goals;
- progress tracking;
- requested personalization;
- support;
- security and fraud prevention;
- troubleshooting; and
- related nutrition or wellness functionality requested by you.
Limited processing may also occur where reasonably necessary for legal compliance, security, fraud prevention, or legal claims.
5. Consent and Requested-Service Processing
Where applicable law requires affirmative consent before collection of consumer health data, MyBite obtains it unless processing is otherwise permitted by law, including where necessary to provide a product or service specifically requested by you.
Where applicable law requires consent before sharing consumer health data, MyBite obtains separate consent when required unless the sharing is otherwise permitted, including where necessary to provide a specifically requested product or service.
Acceptance of broad Terms of Service is not treated as a substitute for separate consumer-health-data consent where separate consent is required by law.
6. Categories of Consumer Health Data Shared or Disclosed
Depending on the feature you request, categories disclosed to processors may include:
- food photographs;
- meal descriptions;
- nutrition-label information;
- barcode or product information;
- nutrition-related inputs;
- limited body or wellness inputs needed for a requested calculation; and
- limited contextual information necessary to provide the requested result.
We seek to minimize disclosed information.
7. Categories of Recipients
AI Processors
Google LLC through paid Gemini API services may process food images, labels, text, and limited contextual information for requested AI analysis.
Cloud Infrastructure
Google Cloud / Firebase may process account, application, nutrition, security, and storage information as configured to provide MyBite.
Subscription Infrastructure
RevenueCat, Inc. may process App User ID, purchase history, entitlement status, and transaction/receipt-related information for subscription management.
MyBite does not intentionally send food photographs, meal history, weight, calorie history, dietary restrictions, allergies, health-consent status, or similar consumer health data to RevenueCat as customer attributes.
Apple
Apple Inc. processes App Store billing, subscription administration, and refund requests under Apple’s applicable terms.
Other Processors and Advisers
Other food/product data providers, security providers, support providers, and professional advisers may receive limited information where necessary for requested functionality, security, compliance, or legal claims.
8. Affiliates
As of the effective date, MyBite has no affiliate that receives consumer health data for its own independent purposes.
9. We Do Not Sell Consumer Health Data
MyBite does not sell consumer health data.
If MyBite ever changes its practices in a way that constitutes a legally defined sale, MyBite will first provide required notice and obtain any separate valid authorization required by law.
10. No Health-Data Advertising Profiles
MyBite does not use or disclose consumer health data to enable third-party targeted advertising based on weight, food intake, calorie intake, dietary restrictions, allergies, nutrition goals, meal history, food photographs, or similar health information.
11. No Cross-Site Consumer-Health Tracking
MyBite does not authorize third parties to collect MyBite consumer health data over time across unrelated websites or online services for targeted advertising or similar cross-context tracking.
12. AI Processing
When you request AI-powered food analysis, limited consumer health data may be transmitted to an AI processor.
MyBite designs ordinary food-analysis requests to exclude unnecessary direct account identifiers.
AI output may be inaccurate and is not medical advice.
MyBite must not be relied upon to identify allergens, contaminants, medical conditions, medication interactions, or food-safety risks.
13. Your Rights
Depending on applicable law, you may have rights to:
- confirm whether MyBite collects, shares, or sells your consumer health data;
- access consumer health data;
- obtain information concerning sources, purposes, and relevant recipients;
- withdraw consent to future collection;
- withdraw consent to future sharing;
- request correction where applicable;
- request deletion;
- appeal a refusal to act on a request; and
- exercise other rights provided by applicable law.

Describe the right you wish to exercise and identify your MyBite account, if any.
We may use reasonable methods to authenticate a request.
Where required by law, you may exercise a right without creating a new account.
15. Withdrawal of Consent
Where consent is the legal basis for future collection or sharing, you may withdraw consent prospectively through available privacy controls or by contacting us.
If the relevant processing is necessary for a feature you request, that feature may become unavailable after withdrawal.
Withdrawal does not affect processing lawfully completed before withdrawal.
16. Deletion
For a valid deletion request, MyBite deletes covered consumer health data as required by applicable law, subject to lawful exceptions.
Where required, MyBite will notify or instruct processors or other recipients that must delete covered information.
Backups may be deleted according to legally permitted restoration cycles.
Limited transaction, security, fraud-prevention, tax, accounting, legal-claim, or other records may be retained where permitted or required.
17. Appeals
Where applicable law provides an appeal right, email jankoviraldev@gmail.com with subject “Consumer Health Data Privacy Appeal.”
Identify the decision you are appealing.
MyBite will respond within the period required by law and, where required, provide regulator or attorney-general information if an appeal is denied.
18. Security and Access
MyBite maintains reasonable administrative, technical, and organizational safeguards appropriate to the sensitivity and risk of consumer health data.
Access by personnel and processors is limited to what is reasonably necessary for permitted purposes.
19. Processor Contracts
Where applicable law requires it, processors handling consumer health data on MyBite’s behalf are subject to written contractual obligations governing confidentiality, permitted processing, security, and compliance with MyBite’s instructions.
20. Geofencing
MyBite does not use geofences around healthcare facilities to identify or track consumers seeking healthcare, collect consumer health data from them, or send health-related notifications or advertisements to them.
21. Washington
For consumers protected by the Washington My Health My Data Act, this Policy is intended to provide the applicable consumer-health-data disclosures.
MyBite does not sell consumer health data.
Where Washington law requires consent to collect or share consumer health data, MyBite obtains that consent unless an applicable statutory exception permits processing, including processing necessary to provide a product or service specifically requested by the consumer.
22. Nevada
Where Nevada consumer-health-data law applies, MyBite provides applicable disclosures concerning the categories of consumer health data collected, sources, purposes, categories shared, categories of recipients, processing practices, consumer rights, material changes, and cross-site consumer-health tracking.
MyBite obtains affirmative voluntary consent where required by Nevada law and does not sell consumer health data without the separate written authorization required by law.
23. Connecticut and Other States
Where Connecticut or another U.S. state imposes additional requirements concerning sensitive or consumer health data, MyBite provides applicable rights and obtains consent or authorization where required.
24. Changes
MyBite will not materially expand the categories or purposes of consumer health data collection, use, or sharing in a manner requiring additional notice or consent without first providing the required notice and obtaining the required consent.
